The trial court answered this question in the negative and sustained preliminary objections in the nature of a demurrer to a complaint filed by Al Hamilton Contracting Company against Seth Cowder and Evelyn Cowder. After careful review of the complaint, we have determined that the plaintiff failed to state a cause of action upon which relief can be granted. Therefore, we affirm the order of the trial court.
